An Attorney’s Report Alleges Abuse of Small Claims in Trucking Schools

An attorney’s report examining more than 7,700 lawsuits filed by an Indianapolis-based trucking school in just two Marion County township small-claims courts alleges systemic abuses that resulted in thousands of judgments against people who may never have stepped foot in the county or the state.

Jeffrey C. Boulden told reporters that “I tried as hard as I could get as many data as possible” to prove there are serious problems. Copies of Boulden’s report were provided this week to the Indiana Supreme Court Justices, key judges, and to media outlets.

Boulden asserts Driver Solutions LLC filed 7,711 suits in Franklin and Warren township small-claims courts from 2008 through April 30, 2012. The total of these cases amounts to approximately 148 each month, which is more than six cases per hour, mainly against driver trainees across the country. It has several branches across the country.

Boulden took 25 percent of the case files into consideration and found that 93 per cent of them were brought against people who reside outside Indiana. He claims this violates the Fair Debt Collections Practices Act (15 U.S.C. 1692i(a). The federal law regarding venue requires such collections actions be filed in the jurisdiction where a contract was signed or where a consumer resides.

In addition, the report claims that defendants in many cases were not properly served with notice via U.S. Mail standard and that approximately 70% of judgments exceed the $6,000. statutory small-claims limit. Boulden believes that any judgments based on such claims should be annulled.

John Baker of Indiana Court of Appeals is one of the judges that received a copy of Boulden’s inspection of Driver Solutions LLC. Baker stated, after reviewing the unsolicited Report titled, “The Poplicola Reporton Marion County Small Claims Court,” that it was quite disappointing. Baker also said, however, that the Supreme Court Task Force Report that examined Driver Solutions LLC in Marion County in May 2012 had been sent to him. Baker believes that no response has been received from lawmakers to Baker’s report. Baker suggested that Marion Superior Courts should incorporate the township courts. Boulden’s Report, from that perspective, he stated, wasn’t surprising.

Baker stated that although this may have been done before significant changes were made in the past, he was disappointed by the lack of reaction from the General Assembly.
